About this event
This masterclass will involve a review of the law relating to receivers, including the appointment of receivers and their powers, and a discussion of some current issues.
Topics include:
- The appointment of a receiver, including traps to avoid
- Discussion of receivers’ powers
- How possession proceedings may be brought when a receiver has been appointed
- Risks for the receiver, including whether a borrower can (as a matter of principle) seek an injunction to prevent an alleged sale at an undervalue

Chris Maynard
Barrister, Tanfield Chambers
Chris practises in the field of property litigation and related disputes. His clients include foreign governments, business entities, charities, local authorities, trustees and individuals. He has a long-standing interest in the law of mortgages dating back to the introduction of mortgage market regulation and the risks of sub-prime lending, later realised in the financial crash of 2007/08. He has acted both for institutional lenders and for borrowers. He claims to be temperamentally attracted to representing the underdog which, in most mortgage cases, he says means individual borrowers. He aims to bring a whiff of controversy which will challenge the audience.
Niraj Modha
Barrister, Tanfield Chambers
Niraj Modha was called to the Bar in 2010 and has practised at Tanfield Chambers since 2011. He specialises in property and commercial litigation and arbitration. He deals with all property matters, but he particularly enjoys tricky real property claims involving easements, boundary disputes, rent charges, land registration, and receivership, and landlord and tenant claims involving insolvency and forfeiture.
Within the last twelve months, Niraj has successfully represented clients in four multi–day trials involving prescriptive rights and trusts of land in the Chancery List at Central London, and in the First–tier Tribunal (Property Chamber). His interests include classic cars and travel, which is just as well, because the last court hearing in which he was instructed by receivers in June 2017 involved a trip to the County Court at Truro.
