CML lenders' handbook for conveyancers

The CML lenders' handbook provides comprehensive instructions for conveyancers acting on behalf of lenders in residential conveyancing transactions. There is a Lenders' Handbook for each legal jurisdiction in the UK and all have a part 1 (general instructions) and part 2 (lender specific instructions). The handbook for England & Wales also includes a part 3 which sets out standard instructions to be used where a conveyancer is representing the lender but not the borrower. Part 3 should be read in conjunction with parts 1 & 2. An example requirements letter to the borrower's conveyancer has also been developed for use in these circumstances. Further information can be found in the FAQs section.

Upcoming changes 30 November 2015: We will remove a reference to part 2 in the buildings insurance requirement section of the Lenders Handbooks for England and Wales, Northern Ireland and Scotland - clause 6.14 England and Wales, 6.13 Northern Ireland and 6.14 Scotland. The clause will require  conveyancers/solicitors to make reasonable enquiries that buildings insurance cover has been arranged for the property from no later than completion and to remind the borrower that they:
  • Must have buildings insurance in accordance with the requirements of the mortgage conditions no later than completion, and
  • Must maintain such buildings insurance cover throughout the mortgage term

Lenders will no longer have an additional list of requirements relating to buildings insurance in part 2 of the Handbook. The change will relate to certificates of title lodged from 30 November.

The part 3 can only be viewed individually but links are provided between the part 1 and part 3 where relevant. You can also view all lenders' responses to a specific question by browsing to any lender part 2, finding the question and clicking on View all answers to the question.
